HCMC not issue regulations on three contents of implementation of Land Law

Ho Chi Minh City revealed that it has not issued regulations on three contents of the implementation of the Land Law.

The People's Committee of Ho Chi Minh City has just submitted a report on the implementation of the Land Law and the National Assembly's resolutions to pilot special mechanisms and policies related to land in the city to the Ministry of Natural Resources and Environment.

Accordingly, Ho Chi Minh City has issued 16 documents to provide detailed regulations for the implementation of the 2024 Land Law and its guiding decrees.

According to the report, there are three contents that Ho Chi Minh City has not issued regulations for the implementation of the Land Law.

Firstly, according to Clause 6, Article 16 of the 2024 Land Law regarding land policies for ethnic minorities, Ho Chi Minh City does not have communes in regions I, II, and III in accordance with the list of 3,434 communes in ethnic minority areas and mountainous regions as specified. On August 14, 2024, the People's Committee of Ho Chi Minh City sent a document to the Ministry of Natural Resources and Environment and the Ministry of Justice, proposing not to issue a regulation on land support policies for ethnic minorities living in Ho Chi Minh City.

Secondly, Clause 3, Article 22 of Decree 88/2024 assigns the Ho Chi Minh City People's Committee to issue detailed regulations under Clause 5, Article 109 of the Land Law on supporting vocational training, career transition, and job search and employment for households or individuals when the State reclaims the land. Currently, Ho Chi Minh City has promulgated Decision No. 96/2024, which stipulates the support levels for vocational training, career transition, and job search for cases in which the State reclaims agricultural land from households or individuals directly engaged in agricultural production.

Thirdly, under Point b, Clause 4, Article 14 of Decree No. 102/2024, the provincial People's Committee is responsible for regulating the fees for selling land use rights auction documents and the costs for organizing land use rights auctions.

The Law on Asset Auctions and Clauses 3 and 4 of Circular No. 48/2017 by the Ministry of Finance has specified the financial policies for asset auction activities, including the fees for selling auction documents to participants in auctions of land use rights and management and the use of funds for organizing these auctions. Therefore, Ho Chi Minh City has not issued regulations on the fees for selling land use rights auction documents and the costs for organizing land use rights auctions.
